What is probate?

Once a loved one has passed, those left behind will have to figure out how to transfer or inherit the decedent's property. In order to do this, you will usually have to go to court. "Probate" is the court-supervised process of validating a will and settling the decedent's estate.

If the decedent left behind a will, an executor (who was named in the will) assumes the responsibility of settling the estate once he or she receives court approval. In the absence of a will, the court appoints an administrator to perform the same duties of an executor.

Duties of the executor or administrator, include:

  • Managing the decedent's assets
  • Notifying heirs and creditors
  • Paying the decedent's debts and taxes
  • Filing all final tax returns
  • Providing accountings to the court
  • After all debts are paid, distributing what's left to the beneficiaries
  • Following all instructions of the court

In California, the probate process takes an average of 9 months to 1 1/2 years to complete, but sometimes longer, especially when there is real estate to be sold or a will contest.

Do all estates go through probate?

For smaller estates valued at $150,000 or less, the case may NOT have to go to court and a simplified process may be used; however, this process CANNOT be used if the estate includes real property such as a house.

If the decedent's property was worth over $150,000, there is no exception and you will have to go to court to open a probate case.
